1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through my online shop at www.artsyroseberlin.de .

2. Conclusion of contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer.
2.2 By clicking on “Order” you submit a binding offer to purchase.
2.3 Confirmation of receipt of the order will be sent by email, but does not constitute acceptance.
2.4 A contract is only concluded through a separate order confirmation or the dispatch of the goods.

3. Prices and payment

3.1 All prices are quoted in euros. I am a small business owner (Section 19 of the German Value Added Tax Act), so no sales tax is charged.
3.2 Shipping costs will be clearly displayed before completing the order.
3.3 Payment options: Prepayment, PayPal, credit card and other methods mentioned on the website.

4. Delivery

4.1 Delivery will be made to the address you provide.
4.2 Delivery times are non-binding unless expressly agreed otherwise.
4.3 In case of unavailability, I will inform you as soon as possible.
4.4 Collection or personal delivery possible after prior arrangement.
4.5 For deliveries outside Germany, additional customs duties, taxes or fees may apply, which you will be responsible for.

5. Right of withdrawal for consumers

– digital products with instant access
– personalized or individually made works

6. Retention of title

The goods remain my property until full payment has been made.

7. Warranty and Liability

7.1 The statutory warranty rights apply.
7.2 The following are not considered defects:
– Color deviations due to monitor display
– artistic features such as visible brushstrokes or textures
– individual commissioned work
7.3 I am only liable for damages caused intentionally or through gross negligence.
No liability for improper handling after delivery (e.g. direct sunlight, high humidity, etc.).

8. Data protection

Your personal data will be processed in accordance with the privacy policy on www.artsyroseberlin.de .

9. Dispute resolution

I am not obliged to participate in dispute resolution proceedings, but I am willing to do so in individual cases.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

10. Offers & Vouchers

Limited-time offers, discounts or gift cards are only valid for the specified period and are not transferable.

12. Final provisions

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
